Dear Colleagues:<\/p>\n

During his election campaign, President Trump promised to eliminate the “Department of Environmental Protection.” “We’re going to have little tidbits left,” he explained, “but we’re going to get most of it out.”\u00a0<\/strong>The 2016 Republican platform proposed responsibility for environmental regulation be shifted to the states, and regulation of CO2 levels forbidden. Trump’s transition team advisor for environmental issues, Myron Ebell, described the environmental movement as “the greatest threat to freedom in the modern world,” but said abolition was only “an aspirational goal.” President Trump’s first budget proposed a 31% cut to EPA resources.<\/p>\n

Presidents, however, don’t implement policy directly \u2013 and often know little about the details. So EPA Administrator Scott Pruitt has the most influence on environmental policy, for as long as he serves.<\/strong>\u00a0While Pruitt has claimed EPA does “very important work” on water and air pollution issues that cross state lines, he has long accused the agency of overreach, violating the rule of law and principles of federalism. As Administrator he has begun rolling back regulations, such as the Clean Power rule; but perhaps more importantly he has shaped EPA’s enforcement, or non-enforcement of existing rules.<\/p>\n

What, then, is the record of the Pruitt EPA? Is it as anti-environment as environmentalists claim? Can he accomplish what they fear?\u00a0<\/strong>Catherine LaCroix has taught environmental law at CWRU for two decades, and joins us to discuss what is being done and what might be done.<\/p>\n

About Our Guest<\/span><\/strong><\/p>\n

Catherine J. LaCroix, J.D.<\/strong>\u00a0teaches environmental law, administrative law, federal courts, land use, advanced environmental law, and appellate advocacy at the Case Western Reserve University School of Law. Her legal practice at Hogan & Hartson focused on environmental health and safety regulation, including compliance counseling, legislative advocacy, consultation on environmental matters in real estate and other commercial transactions, appellate litigation, and administrative proceedings under a range of federal statutes. Professor LaCroix has been admitted to the D.C. Bar.<\/span><\/p>\n

Where We Meet<\/span><\/strong><\/p>\n

The Friday Public Affairs Lunch convenes each Friday when classes are in session, from 12:30 p.m. to 1:30 p.m. Our programs are open to all and no registration is required. We usually meet in the Dampeer Room of Kelvin Smith Library.<\/span><\/p>\n

* Kelvin Smith Library requires all entrants to show identification when entering the building, unless they have a university i.d. that they can magnetically scan. We are sorry if that seems like a hassle, but it has been Library policy for a while in response to security concerns. Please do not complain to the library staff at the entrance, who are just doing their jobs.<\/span><\/p>\n

The Dampeer Room is on the second floor of the library. If you get off the elevators, turn right, pass the first bank of tables, and turn right again. Occasionally we need to use a different room; that will always be announced in the weekly e-mails.<\/span><\/p>\n

Parking Possibilities<\/span><\/strong><\/p>\n

The most convenient parking is the lot underneath Severance Hall. We regret that it is not free. From that lot there is an elevator up to street level (labeled as for the Thwing Center); it is less than 50 yards from that exit to the library entrance. You can get from the Severance garage to the library without going outside. Near the entry gates – just to the right if you were driving out – there is a door into a corridor. Walk down the corridor and there will be another door. Beyond that door you’ll find the entrance to an elevator which goes up to an entrance right inside the doors to Kelvin Smith Library.<\/span><\/p>\n

In spite of hopeful moments at the Winter Olympics, tension regarding North Korea’s nuclear program remains high. White House National Security Adviser H.R. McMaster stated in December that, \u201cthe possibility of war with North Korea increases every day.\u201d Considering the possibility of massive casualties on the Korean peninsula and perhaps beyond, then if the probability of conflict is increasing, the benefits of a diplomatic solution would increase as well. What are the obstacles to and prospects of a diplomatic resolution of the North Korean nuclear crisis?<\/p>\n

A diplomatic solution must involve some understanding between the United States and China. There is near-consensus that fears about potential ramifications of regime collapse in North Korea are behind China\u2019s reluctance to apply measures that could halt its nuclear program. If so, then reducing uncertainty about the costs of regime collapse would be the most direct way to enhance Sino-American cooperation on the issue. Professor Bae will assess the possible elements of such an understanding between the U.S. and China, and the obstacles to creating such an agreement.<\/p>\n

Joonbum Bae is Visiting Assistant Professor in the Department of Political Science at Hobart & William Smith. He earned his Ph.D. in political science from UCLA and was a postdoctoral research fellow at the Scowcroft Institute for International Affairs of Texas A&M University. He earned his MA in international relations at Seoul National University, and his research has been funded by the George Marshall Foundation and the Institute for Global Conflict and Cooperation.<\/span><\/p>\n

The opioid crisis has produced a multipronged, interdisciplinary response in which law plays a central role. This talk will discuss the current litigation addressing the crisis, as well as legislative response, and the interaction between the law and the practice of medicine.<\/p>\n

Abbe R. Gluck joined the faculty of Yale Law School in 2012, after serving on the faculty of Columbia Law School and extensive experience in New York City and state of New Jersey governments. She earned her B.A. Summa Cum Laude and J.D. from Yale, and clerked for then-Chief Judge Ralph K. Winter on the U.S. Court of Appeals for the Second Circuit and for Supreme Court Justice Ruth Bader Ginsburg. Her work has been published in, among other journals, the\u00a0Yale Law Journal<\/em>,\u00a0Harvard Law Review<\/em>,\u00a0Stanford Law Review<\/em>,\u00a0Columbia Law Review<\/em>, and the\u00a0New England Journal of Medicine<\/em>. She served as co-counsel on Supreme Court briefs on both the\u00a0NFIB v. Sebelius<\/em>\u00a0and\u00a0King v.
